Acceptable Terms of Use statement

By accessing this system (the System), Dealer and each user (collectively Dealer) understand and acknowledge: (i) it contains personally identifiable information and other information that is confidential and proprietary to Ford; (ii) responsibility for maintaining the security and confidentiality of the information and (iii) the information may only be used for purposes authorized by Ford and in compliance with all applicable laws, including privacy laws. Ford reserves the right to modify or discontinue the System without notice and/or remove any Dealer access to the System for any reason, including breach of these Terms of Use or applicable laws. In no event shall Ford be liable or responsible for damages of any kind (whether direct or indirect) related to Dealer use of the System, including but not limited to content, availability, or viruses that may infect Dealer systems. Dealer use is at its own risk and Ford makes no representations or warranties or guarantees or indemnities of any kind whatsoever, whether express or implied with respect to the System or information contained in the System. Dealer agrees to defend, indemnify and hold harmless Ford, its affiliates, officers, directors, agents and employees from any and all claims that may arise due to Dealer use of the System, including but not limited to breach of these Terms of Use or any applicable laws.

By inserting data, including customer data, Dealer authorizes Ford to acquire such data from Dealer, and to use and display such data in the System, including making such data available to Dealer and other Ford and Lincoln dealers. Dealer is responsible for customer consent for Ford and Dealers to use such customer data to address such customer requests, and in accordance with privacy laws. Dealer further agrees that customer information is only to be used for addressing customer requests, as authorized by such customer, and in accordance with all applicable privacy laws.

Dealer is responsible for Dealer personnel access to the System and the use and custody of any Dealer personnel access codes and passwords.

Ford grants Dealer a non-exclusive, royalty free, limited license to access the System which may be removed at any time at Ford’s discretion, including in cases of misuse of passwords or information contained in the System. Any use of the System, unless as specified in these Terms of Use, is prohibited, including but not limited to reproduction, destruction, modification, sale, distribution, display, or loss of information. All marks, logos, and other intellectual property are owned or licensed by Ford and any unauthorized use is prohibited.
